U.S. slams deportation of Uyghur refugees from Cambodia to China

(CNN) -- The U.S. State Department said Sunday it was "deeply disturbed" at the deportation of 20 Uyghur asylum seekers from Cambodia back to China.

The deportation "will affect Cambodia's relationship with the U.S. and its international standing," said acting State Department spokesman Gordon Duguid in a statement.

It occurred on Saturday at the request of China, the U.S. said.

"The United States is deeply concerned about the welfare of these individuals, who had sought protection under international law," Duguid said.

"We are also deeply disturbed that the Cambodian government decided to forcibly remove the group without the benefit of a credible process for determining refugee status and without appropriate participation by the Office of the U.N. High Commissioner for Refugees."

Kitty McKinsey, a coordinator with the U.N. High Commissioner for Refugees agency in Asia, told CNN on Saturday that the refugees had been seeking asylum. China's northwestern region was wracked by ethnic violence between Han Chinese and Uyghur Muslims earlier this year, and the Uyghurs fled to Cambodia to escape the unrest.

McKinsey said the UNHCR considers the deportation a breach of international law, and Uyghur human rights activists have expressed concern about the move. The Uyghur American Association also expressed concern in a statement.

The 20 were held in handcuffs and leg shackles and were not given any food to eat on Friday, according to the association. They were part of a group of 22 Uyghurs seeking refuge in Cambodia, all of whom were under UNHCR protection when taken into custody.

"The United States strongly opposed Cambodia's involuntary return of these asylum seekers before their claims have been heard," the State Department said.

Duguid urged the Chinese government to "uphold international norms and to ensure transparency, due process and proper treatment of persons in its territory" now that the Uyghurs have been returned.

Cambodian and Chinese officials could not immediately be reached for a response. But a Cambodian state media outlet, Agence Kampuchea Presse, reported that Chinese Vice President Xi Jinping is to arrive in Cambodia on Sunday for a three-day visit.

UN Special rapporteur on adequate housing denounces forced evictions in Cambodia

UN, Geneva - The following statement on the latest in a series of forced evictions in Cambodia was issued today by the UN Special Rapporteur on adequate housing, Raquel Rolnik:

“More than 130 families were forcibly evicted during the night of 23 and 24 January 2009 from Dey Krahorm, in central Phnom Penh to make way for a private company to redevelop the site.

The forced eviction was carried out in the middle of the night, without prior notice and the shelters belonging to this poor community were torn down and destroyed. This situation has grave consequences for all the victims, but particularly the women and children. Reports also state that prior to the eviction, the community suffered intimidation and community representatives and members were also subjected to criminal charges.

It is regrettable that the ongoing negotiations with the residents were abandoned, casting aside a valuable opportunity to reach a just and lawful solution to this longstanding dispute. It is now of utmost importance that the rights of the residents to fair compensation for their lost homes and property and the provision of adequate alternative housing are fully respected.

Unfortunately this is by no means an isolated case, and the increase in forced evictions throughout Cambodia is very alarming. Reports indicate that tens of thousands of poor people have been forcibly evicted and displaced, pushing them into homelessness and further destitution.

In Cambodia, a consistent pattern of violation of rights has been observed in connection with forced evictions: systematic lack of due process and procedural protections; inadequate compensation; lack of effective remedies for communities facing eviction; excessive use of force; and harassment, intimidation and criminalization of NGOs and lawyers working on this issue.

Forced evictions constitute a grave breach of human rights. They can be carried out only in exceptional circumstances and with the full respect of international standards. Given the disastrous humanitarian situation faced by the victims of forced evictions, I urge the Cambodian authorities to establish a national moratorium on evictions until their policies and actions in this regard have been brought into full conformity with international human rights obligations.”

The former Special Rapporteur on adequate housing conducted a mission to Cambodia in 2005 and presented a mission report on his findings and recommendations (E/CN.4/2006/41/Add.3). Concerns on forced evictions in Cambodia have been shared through a large number of communications by the Special Rapporteur with the authorities. These communications remain unanswered to date.

Lack of Justice Leaves Unionists in Fear for Their Lives

(New York, December 28, 2008) - Cambodian authorities should exonerate and free Born Samnang and Sok Sam Oeun, who were unfairly sentenced to 20 years in prison in 2005 for the murder of labor leader Chea Vichea, said three international human rights organizations and the world's largest trade union confederation in a joint statement released today.

The Cambodia Supreme Court will hear the case on appeal on December 31, 2008.

The joint statement was issued by Human Rights Watch, the International Trade Union Confederation, and the Observatory for the Protection of Human Rights Defenders (a joint program of the International Federation for Human Rights and the World Organization Against Torture), which have all closely followed the case since Vichea's murder.

"The Cambodian Supreme Court should rely on the evidence and not give in to government pressure when it reviews the case," said Sara Colm, senior researcher for Human Rights Watch. "Born Samang and Sok Sam Oeun have already spent five years behind bars for a crime they did not commit, and it is time for justice to be done in this case."

Chea Vichea, 36, was the founder and president of the Free Trade Union of Workers of the Kingdom of Cambodia (FTUWKC) and a vocal supporter of the opposition Sam Rainsy Party. He was shot and killed in broad daylight in front of a newsstand in Phnom Penh on January 22, 2004. Vichea was well known for his outspoken efforts to organize garment workers and to fight for improved working conditions in Cambodia, work he continued in spite of death threats.

The investigation into the high profile murder was marred by alleged police brutality and forced confession by one of the suspects, intimidation of witnesses, and political interference in the judicial process. The prosecution and conviction of Born Samnang and Sok Sam Oeun have drawn extensive criticism from Cambodian and international human rights activists, union advocates, lawyers, and United Nations officials.

The International Labour Organization (ILO), which sent a fact-finding mission to Cambodia in April 2008 to investigate the murders of trade unionists, has repeatedly expressed strong concerns about the convictions of the two men and called for a fresh investigation into Chea Vichea's murder.

"The lack of justice in this case leaves trade unionists in fear for their lives," said Guy Ryder, general secretary of the International Trade Union Confederation, whose 311 affiliates represent 168 million workers worldwide. "Even ILO leaders who were on an official ILO mission to Cambodia earlier this year were subject to intimidation."

In a report released in November 2008, the ILO sharply criticized the Cambodian government for not effectively stemming a series of violent and deadly attacks against trade unionists. At the core of the problem, the report said, is Cambodia's lack of an independent judiciary, which allows the real perpetrators of such attacks to evade justice. The atmosphere of impunity in Cambodia reinforces the climate of violence and insecurity, the report said, which in turn "is extremely damaging to the exercise of trade union rights."

The ILO report's findings, which could affect the future of Cambodia's important garment industry, noted that during the ILO mission in April, the government "demonstrated an unwillingness to engage in fully frank discussions" and "provided no concrete indications" that it would act upon any of the ILO's recommendations.

In addition to the murder of Chea Vichea, there has been an ongoing pattern of violence against trade union activists in Cambodia. This includes the murders of FTUWKC official Hy Vuthy in February 2007 and FTUWKC Steering Committee member Ros Sovannarith in 2004, and a series of threats and physical assaults against FTUWKC representatives and other trade unionists.

The four organizations urged the Cambodian government to launch a full and impartial investigation into Chea Vichea's murder, as well as an independent and public inquiry into the handling of the prosecution of Born Samnang and Sok Sam Oeun.

"If the Supreme Court fails to provide long-overdue justice by releasing these two innocent men, it will only further highlight the lack of progress toward rule of law in Cambodia," said Souhayr Belhassen, president of the International Federation for Human Rights.

The organizations also urged the Cambodian government to take prompt action to address the key issues highlighted by this case: Cambodia's endemic impunity and lack of rule of law, government interference in the judiciary, intimidation and violence faced by trade union members and leaders, and widespread torture by the police.

"It's time for the Cambodian authorities to finally deliver justice to Born Samnang and Sok Sam Oeun, and stop the widespread practice of torture by Cambodian police to force confessions out of criminal suspects," said Eric Sottas, secretary-general of the World Organisation Against Torture.

Background

The police and court investigations into Vichea's killing were marred by a series of procedural flaws and violations of international legal standards. The police allegedly tortured Born Samnang to obtain a confession. A judge who initially dropped the charges against the two men for lack of evidence was swiftly removed from his position, and the charges were reinstated. The subsequent trial of the two men was conducted in a manner that flagrantly violated Cambodian law and international fair trial standards. In April 2007, the country's Appeal Court upheld their convictions despite the state prosecutor acknowledging that there was insufficient evidence.

Chea Vichea's family members say they believe Born Samnang and Sok Sam Oeun are not responsible for the crime, as has Var Sothy, the newsstand proprietor who was the key eyewitness to the killing. She subsequently fled Cambodia in fear for her life.

As an example of the politicization of the Cambodian judiciary, the Chief Justice of the Supreme Court, Dith Munthy, is a member of the Standing Committee of the ruling Cambodian People's Party. The lack of judicial independence has been cited in successive UN human rights reports for the past 15 years and is a major concern in the ongoing attempts to bring Khmer Rouge leaders to justice. The Cambodian government has long acknowledged weaknesses in the judiciary and made commitments to address this, but has taken no meaningful steps to do so.

General Hok Lundy, Cambodia's Notorious and Brutal Police Chief, He Was Widely Feared

General Hok Lundy, Cambodia's notorious police chief and close ally of prime minister Hun Sen, has died at the age of 58 in a helicopter crash. He was travelling from the capital, Phnom Penh, to the south-eastern province of Svay Rieng. None of the helicopter's other occupants - General Sok Saem, deputy commander of the Cambodian infantry, the pilot and co-pilot - survived the crash.

A four-star general and member of the politburo of the ruling CPP (Cambodian People's party), Hok Lundy was a man who inspired fear not only in opposition ranks, but also in members of his own party. Born in Svay Rieng, he first rose to prominence as the governor of Phnom Penh in 1990. Four years later, Hun Sen appointed him national police chief, reporting directly to the prime minister. He never took orders from Sar Kheng, his nominal boss as minister for the interior.

In the aftermath of a bloody power struggle in 1997 between partners in the coalition government, many royalist generals were captured and killed in cold blood. Hok Lundy played a key part in these mopping-up operations and extrajudicial executions. A Funcinpec (royalist) party minister, Ho Sok, was detained at the interior ministry and shot dead by a police unit there. It is known that Sar Kheng had ordered the police to ensure Ho Sok's safety, but Hok Lundy chose to handle things his own way, according to high-ranking sources close to the minister.

This was later confirmed by Heng Pov, the former Phnom Penh police chief, after he fell out with Hok Lundy. While he was on the run from criminal charges stacked against him, Heng Pov accused Cambodia's police supremo and security chief not only of murdering Ho Sok, but also the union leader Chea Vichea and film star Piseth Pilika, in revelations to the French magazine L'Express.

Diplomats in Phnom Penh routinely referred to Hok Lundy as a "thug". This reputation was further enhanced by his role in the burning of the Thai embassy in January 2003. The police chief, who was normally no fan of demonstrators, had permitted anti-Thai protestors to run riot, attacking Thai-owned properties all over Phnom Penh. In the aftermath of this violence he persuaded the prime minister to sack the capital's popular governor, his arch-rival Chea Sophara, as a scapegoat.

That Hun Sen sided with his police chief was no surprise, as Hok Lundy had already married his daughter off to one of Hun Sen's sons, thus consolidating close family ties among Cambodia's clannish ruling elite.

Lundy was also implicated in drug trafficking, the return of refugees to countries where they faced persecution and human trafficking. Two US Drug Enforcement Agency officials and a former unnamed US ambassador to Cambodia confirmed to Human Rights Watch that the US government was aware of Hok Lundy's involvement in drug trafficking. In February 2006, the US State Department's human trafficking office specifically cited Hok Lundy's alleged involvement in human trafficking as grounds for denying him a visa. That decision was linked to a brothel raid in December 2004, after which Hok Lundy reportedly ordered the release within hours of several traffickers, before an investigation could be conducted.

However, after 9/11 the Cambodian government had become cooperative in the war on terrorism. In March 2006, the month after the refusal of a visa, the FBI nonetheless awarded Hok Lundy a medal for his support for the US global war on terrorism, and the US ambassador to Cambodia, Joseph Mussomeli, praised Lundy's cooperation with the US in drug trafficking and human smuggling. State Department officials confirmed at the time that Hok Lundy had been invited to visit the FBI specifically because of his purported cooperation in counterterrorism. When, in April 2007, the FBI invited him to Washington for such discussions, Brad Adams, Human Rights Watch's Asia director, commented: "Hok Lundy's alleged involvement in political violence and organised crime in Cambodia means that the FBI should be investigating him, not hosting him."

The sudden death of a man who had made many enemies has sparked much speculation in Cambodia that the helicopter crash may not have been an accident, despite reports of bad weather. The helicopter caught fire, and the government has promised an investigation. Many people would have cause to celebrate the death of Cambodia's Mr Untouchable.

A French online agency, K-Set, has reported that Chea Mony, the brother
of the slain trade unionist and presidentof the Free Trade Union of Workers in the Kingdom of Cambodia, has said that the death of the top policeman means that the number of murders of politicians, entertainers and Cambodian reporters will undoubtedly be reduced, but regrets that he was never brought to justice.

US State Department Examines Cambodian Rights Record

Looking back over the past year the US State Department has found repeated instances of intimidation and violence against Khmer Kampuchea Krom monks and citizens. The report goes on to show the lack of rights in both Cambodia and Vietnam, with religious rights bearing the brunt of abuses reported.

Below is an excerpt from the US State Department Human Rights Report for Cambodia in 2007:

Political activists continued to be the victims of killings. On February 27 [2007], Eang Sok Thoeurn, a Khmer Kampuchea Krom monk, was found dead […] in the Tronum Chhroeung Monastery in Kandal Province. The deceased monk was discovered the morning after he participated in a demonstration in front of the Vietnamese embassy in Phnom Penh for the rights of Khmer Kampuchea Krom persons living in Vietnam. Police quickly declared the death a suicide and disposed of the body without further investigation. NGOs and Khmer Kampuchea Krom groups suspected the killing was politically motivated.

On June 30 [2007], Khmer Kampuchea Krom monk Tim Sakhorn, head of a pagoda in the Kirivong District of Takeo Province for more than 10 years, disappeared. Previously, on orders of the country's top Buddhist leader, Great Supreme Patriarch Tep Vong, monks from Phnom Penh had defrocked Tim Sakhorn, after which unidentified persons believed to be attached to the MOI [Ministry of Interior] pushed him into a vehicle and drove away. The defrocking order stated Tim Sakhorn "broke the solidarity" between Cambodia and Vietnam by using pagodas to spread propaganda that affects the dignity of Buddhism. The monk was known locally for providing food and shelter to Khmer Kampuchea Krom coming from Vietnam. The MOI stated that Tim Sakhorn volunteered to go to Vietnam after he was defrocked, and ministry officials produced a document stating this intent. While signed by Tim Sakhorn, the handwritten document appeared not to be in his writing. On August 2 [2007], Tim Sakhorn reappeared in court custody in Vietnam, held on charges of destroying political solidarity. In September [2007] the Information Ministry stated that the Cambodian consulate in Ho Chi Minh City was investigating Tim Sakhorn's condition in detention. On November 8 [2007], a Vietnamese newspaper reported that a court in Vietnam convicted Tim Sakhorn of undermining solidarity between Cambodia and Vietnam and sentenced him to one year in prison.

On February 27 [2007], police and military police dispersed 60 Khmer Kampuchea Krom Buddhist monks demonstrating at the Vietnamese embassy in Phnom Penh during a state visit by the Vietnamese president. Demonstrators assembled to support Khmer Kampuchea Krom monks in Vietnam who had been defrocked and arrested, urging their release and reinstatement as monks. The next morning one monk protester was found dead […] On March 16, police and local authorities in Kandal Province prevented the deceased monk's Khmer Kampuchea Krom community members and monks from holding his funeral.

On April 20 [2007], police and municipal authorities dispersed 80 Khmer Kampuchea Krom monks assembled at the Vietnamese embassy trying to deliver a petition in protest of alleged Vietnamese government rights abuses of Khmer Kampuchea Krom living in Vietnam. The protesters decided to go to another embassy to present the petition. On the way a group of unidentified, non-Khmer Kampuchea Krom monks and laypersons aggressively intercepted the demonstrators and attempted to disperse them. In the ensuing scuffle, one of the Khmer Kampuchea Krom monks was injured. Authorities did not intervene in the confrontation and did not conduct an investigation. On December 17 [2007], 40 monks sought again to deliver a petition to Vietnamese embassy officials for the release of Tim Sakhorn and other Khmer Kampuchea Krom monks imprisoned in Vietnam, and also for the return of land that they claimed the Vietnamese government seized from Khmer Kampuchea Krom persons in southern Vietnam. Police attempted to disperse the crowd, but the monks refused to disband, and violence broke out […] A local NGO reported that six monks were injured; police stated that some of the police sustained minor injuries.

CONCLUSIONS AND RECOMMENDATIONS

99. Year after year, the Special Representative’s predecessors and others have addressed the problems of the legal and judicial system in Cambodia and made numerous recommendations, to no avail. The Government has no incentives for reform, as the international community continues to make large financial contributions regardless of widespread violations of human rights.

100. A distinguished Cambodian legal scholar recently commented that “the Government is the least serious about the legal and judicial programme”. The World Bank shelved a project because of “a lack of senior-level commitment to the implementation of a concerted legal and judicial reform agenda within the Executive and Judicial branches of the Government”. Another donor has said that numerous plans and councils on good governance are “little more than a studied attempt to tell donors what they want to hear”.


Recommendations to the Government


101. The Government has primary responsibility for the rule of law. The Special Representative would stress the following recommendations, many of which were made previously:


  • The Government must respect the independence of all prosecutors and judges, including those (and defenders and administrative staff) within ECCC.

  • The Government must devote more resources to the justice sector. Efforts to train lawyers and to recruit prosecutors and judges should continue and the aim should be for everyone to be within easy reach of a court and for delays in proceedings to be minimized.

  • The Government should appoint a committee drawn from Government, the BAKC, human rights NGOs and local and foreign experts, to advise on the organization of legal aid. Its recommendations should be implemented speedily.

  • The Government must promote respect for the rule of law within the State and society. It must set the example, as guardian of the Constitution and the law. Laws must be implemented fairly and fully and effective remedies for the violation of rights ensured, if people are to trust the notion of rule of law.

  • The Government must urgently enact laws on demonstrations and anti-corruption, ensuring that they comply with the Constitution and human rights standards.

  • The Government must protect the rights of indigenous persons and others who, due to illiteracy, customary practices and expectations, communal forms of organizations etc., are not familiar with the law or its procedures, the rules for making of economic transactions or with the market economy. Steps must be taken to ensure that State authorities, including communes, are no longer involved in transactions of dubious morality or law that undermine the rights of these communities and individuals.

  • The Government must do all it can to stop forced evictions. It must never be complicit in unlawful evictions. Internationally accepted guidelines must be observed, including the principles that nobody should be made homeless as a result of development-based evictions, the full and informed consent of those targeted for eviction. Evictions should be carried out only in exceptional circumstances, and solely for the purpose of promoting the general welfare in a democratic society. The use of force should be prohibited. No one should be imprisoned in relation to protecting their rights to land and housing and anyone detained in this context should be released. A moratorium on forced evictions should be declared, to allow the determination of the legality of land claims to be made in an objective and fair manner.

  • The Government must establish an independent authority to receive complaints about maladministration by the State (including institutions of justice). A Human Rights Commission fully established on the Paris Principles could be given this task.

  • The Government must respect the duty and right of civil society to promote and protect human rights and observe United Nations resolutions on the rights of human rights defenders. No restrictions should be placed on reasonable activities of local communities and non-governmental associations.

  • The Government must deal fairly with specific cases brought to its attention in recent reports of the Special Representatives and human rights organizations, including the circumstances in which the Venerable Tim Sakhorn disappeared. These steps should include justice for the alleged killers of union leader Chea Vichea and bringing to justice his real killers.



Recommendations to civil society actors

102. The Special Representative stresses the important contribution of civil society (including non-governmental organizations, lawyers, universities, think tanks and other educational and research institutions) to the common effort to establish the rule of the law. He encourages them to pursue their efforts, with determination, patience and courage, in a spirit of openness, dialogue and cooperation with the government authorities. They should continue to provide people with information about human rights, institutions and remedies, and with a voice when the administration, lawmakers and the judiciary do not listen. Discussion with the people about the Special Representative’s reports and feedback should be encouraged.

103. Educational institutions and NGOs should engage the public, through seminars, media and publications, on the procedures and practices as well as the rulings and judgements of ECCC, to create awareness of the meaning and importance of the rule of law.

Recommendations to the international community, including United Nations institutions

104. To be seriously considered and implemented by the Government, the recommendations of the successive Special Representatives need to be endorsed and supported by foreign Governments and international agencies.


  • The international community should set up or facilitate the setting up of an independent expert commission to review the working of the legal and judicial system, to make recommendations, and to report annually to the international community and the Royal Government of Cambodia, one month ahead of the consultations between the Government and the donors and lenders. The commission should develop effective and realistic criteria to assess progress, paying particular attention to the enforcement of the law and the independence of the prosecution and judges. The report should form the basis of consultations.

  • Foreign Governments or agencies providing assistance in drafting laws must ensure that the law they are proposing is consistent with human rights. This raises no difficulties in respect of Cambodia’s sovereignty. This is also an international obligation of each and every Member State of the United Nations, under the Charter and under the treaties they have ratified.

  • Foreign embassies, collectively or bilaterally, should engage the Government in dialogues on human rights and urge the Government to stop the most egregious violations. They should emphasize that respect for human rights is an essential basis of the partnership between them and the Cambodian State and people, and for the pursuance of a development process that places human beings and environment at its heart, rather than unlimited profit and greed, at its heart.

  • Since the Constitutional Council has stated that human rights treaties are binding, it is necessary that the decisions of the treaty bodies and of international and foreign courts and tribunals should be taken into account when applying the law. This approach would reinforce the impact that ECCC is expected to have on improvements in the Cambodian legal and judicial system. OHCHR should translate and disseminate major interpretations and conclusions of the treaty bodies.



Note: The chief monk of Phnom Denh pagoda in Takeo Province and an ethnic Khmer from Southern Viet Nam was defrocked on the order of the Chief Patriarch on grounds that his activities in providing shelter to monks from the Khmer Krom minority in Viet Nam fleeing alleged religious persecution had undermined good relations between Cambodia and Viet Nam. He was then driven away by unidentified persons and his whereabouts were unknown until August when he appeared in custody in Viet Nam.
